Pursuant to Article 13 of Regulation (EU) 2016/679 (GDPR), we inform you that your personal data, freely provided by you, will be processed by TM MOTO S.r.l., the Data Controller, using electronic and paper-based methods for the following purposes: order and purchase management, shipment management, returns management, payment processing, compliance with accounting and tax obligations, management of requests including post-purchase requests, and management of any disputes. The legal basis for the processing is the fulfillment of a contract and pre-contractual measures adopted at the data subject’s request, or the fulfillment of legal obligations (Article 6, paragraph 1, letters b) and c) of the GDPR). We also inform you that, subject to your express consent, your data may also be processed for the Data Controller’s marketing activities, such as sending newsletters, informational or promotional materials, invitations to events, and product or service sponsorships. The data you provide will not be disclosed or used for further or different purposes. Providing your personal data is voluntary; however, failure to provide data marked with an asterisk (*) will prevent us from responding to your request. If you decide to provide us with your data, we inform you that it will be processed by personnel authorized by the Data Controller and will be retained exclusively for the time necessary to fulfill the indicated purpose (sending the purchase, compliance with return terms, warranty), unless otherwise required by law, including that set forth in Article 2220 of the Italian Civil Code. For marketing purposes, your data will be retained until you withdraw your consent, which may occur at any time. Any further retention of the aforementioned data, or part thereof, may, however, be required to assert or defend one’s rights in any jurisdiction, particularly in court. Your data will not be disclosed outside the EU. If necessary, the Company will obtain the necessary guarantees for recipients of data communication located outside the European Union to ensure that the data transfer is carried out in accordance with the provisions of Chapter V of the GDPR. We inform you that your data may be disclosed to third parties who perform specific services on behalf of the Data Controller to ensure the proper pursuit of the aforementioned purpose. The list of these third parties is available upon request from the Data Controller. Finally, we remind you that, pursuant to Articles 15 et seq. of the GDPR, you have the right to obtain confirmation of the existence or otherwise of data concerning you, to obtain information on the source and the purposes and methods of processing, to update, rectify, or integrate the data, as well as to erase any data processed unlawfully or for any of the reasons specified in Article 17 of the GDPR.
