TYPES OF DATA PROCESSED

Navigation data

The computer systems and software procedures used to operate this website acquire, in the course of their normal operation, some personal data whose transmission is implied by the use of Internet communication protocols. This is information that is not collected to be associated with data subjects, but that by its very nature could, through processing and associations with data held by third parties, allow users to be identified. This category of data includes the IP addresses or domain names of computers used by users connecting to the site, URIs (Uniform Resource Identifier) of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the reply given by the server (successful request, error, etc.) and other parameters related to the user’s operating system and computer environment. These data are used only for the purpose of obtaining anonymous statistical information on the use of the site and to check its proper functioning and are deleted immediately after processing.

Data voluntarily provided by the user

The optional, explicit and voluntary submission of personal data by the user in the registration forms on this site or calling any telephone numbers listed within the site, entails the subsequent acquisition of the data provided by the sender, necessary for the provision of the service or information requested.

Anonymous or aggregate data

Anonymization is a process that aims to prevent the identification of the data subject. Anonymized data is not covered in the scope of data protection legislation. Aggregate data may be derived from personal data provided by the user but are not considered personal data since, as specified, they do not allow either directly or indirectly the identification of the data subject.

TM MOTO will not sell or distribute to third parties the personal data collected unless it has obtained an explicit and free consent from the data subjects or unless this is expressly required by law. Subject to the consent of the data subjects, personal data may be used to send promotional information also on third parties.

PROCESSING METHODS AND STORAGE TIMES

Personal data are processed, including with the aid of automated tools for the time strictly necessary to achieve the purposes for which they were collected.

Specific security measures are observed to prevent data loss, illegal or incorrect use and unauthorized access. The Data Controller has taken all appropriate security measures, inspired by the main international standards to minimize the risks related to the confidentiality, availability and integrity of collected and processed personal data.

DATA SHARING, COMMUNICATION AND DISSEMINATION

The processing related to the web services of this site take place at the aforementioned office of the Data Controller and are carried out only by personnel expressly authorised by the latter. The data collected may be shared, transferred or communicated to other companies for activities closely related to and instrumental in the operation of the service, as the management of the computer system or to any third-party service providers who may be entrusted with occasional maintenance. In these cases, the Data Controller shall appoint such third parties as Data Processors pursuant to Article 28 of the GDPR. Apart from these cases, personal data will not be communicated to third parties except as provided by contract or law, or unless  specific consent is requested from the interested party. In this sense, personal data could be transmitted to third parties, but only and exclusively in the case where:

  1. a) there is explicit consent to share data with third parties;
  2. b) there is a need to share information with third parties in order to provide the requested service;
  3. c) this is necessary to comply with requests from the Judicial or Public Security Authority.

No data from the web service is disseminated.

TRANSFER OF PERSONAL DATA TO THIRD COUNTRIES

Personal data will not be transferred to third countries, meaning countries outside the European Union or the European Economic Area. If this happens, the Data Controller declares and guarantees to comply with the provisions of art. 44 et seq. of the GDPR.

RIGHTS OF DATA SUBJECTS

The legislation for the protection of personal data expressly provides for certain rights belonging to the subjects to whom the data refers (so-called data subjects). In particular, in compliance with Articles 15 et seq. of Regulation (EU) 2016/679, each data subject has the right to obtain confirmation of the existence or not of data concerning him, to obtain the indication of the origin and purpose and method of processing, the right to object to processing, the right to updating, rectification, integration of data as well as their deletion if processed in violation of law or if there is one of the reasons specified by Article 17 of Regulation (EU) 2016/679.

DATA RETENTION

TM MOTO S.r.l. informs you that the collected data will be kept only for the time necessary to fulfill the indicated specific purposes. The possible further storage of data or part of the data may be arranged to assert or defend its rights in any place and in particular in the courts as well as to respond to explicit requests of the interested party, as requests for receipt of promotional material where express consent has been given.

The data collected through profiling cookies will be stored in full for 13 months from the date of collection and/ or installation of the relevant cookie.

CHANGES TO THIS PRIVACY POLICY

The Data Controller periodically reviews its privacy and security policy and, if necessary, revises it in relation to regulatory, organisational or technological changes. In the event of a change to the policies, the new version will be published on this site page.

EXERCISE OF RIGHTS

For any communication regarding privacy policies, how our Company handles personal data, as well as to enforce your rights under the law on the protection of personal data, the data subject can contact the Data Controller by writing to the appropriate contact email addresses indicated above.

Without prejudice to any other administrative or judicial remedy, the data subject who considers that the processing concerning him or her violates the GDPR has the right to lodge a complaint with a supervisory authority, in particular in the Member State where he or she habitually resides, work or the place where the alleged breach occurred.
